Totally right, so the below should what's wanted.
spin_lock(&hugetlb_lock);
if (PageHuge(head))
if (!HPageFreed(head) && !HPageMigratable(head))
ret = -EBUSY;
else
ret = get_page_unless_zero(head);
spin_unlock(&hugetlb_lock);
