yup.  You could do

	foo = kmalloc(size, GFP_NOWAIT);
	if (!foo) {
		spin_unlock(...);
		foo = kmalloc(size, GFP_KERNEL);
		if (!foo)
			...
		spin_lock(...);
	}

that avoids the lock/unlock once per allocation.  But it also increases
the lock's average hold times....
